‘Legal’ Votes & A Potential Court Coup

Shelt Garner
@sheltgarner

Let me be clear — this is nothing more than me attempting to make concrete my lingering abstract fears that since “autocrats never lose,” TrumpBarr will somehow stage a coup in the courts.

Republicans have every reason to believe they will be successful, even though at this late date if they were, they pretty much would cause a civil war or a revolution. The reason is — they’ve lost politically. So any extra-political attempt on their part to win the election would be seen, rightfully, as nothing less than a coup.

But they were willing to rush the confirmation of Amy Coney Barrett for this very reason. They honestly no longer believe in liberal democracy and at this point see it as just an obstacle. There’s a reason why most of the Republican Party has been quiet about the political win of Biden — they are seriously willing to attempt to win the election in the courts.

In fact, I would suggest that the only thing standing in the way of them achieving that goal (at least initially) is Trump is a very incompetent moron. But this is what they’re going to do — they’re going to attack the election from the “legal vote” point of view. They want SCOTUS to redefine what a “legal” vote is to such an extent that should their court coup be successful, they can use it as a talking point after the fact.

They will tell 48% of the electorate that listens to them that we’re not a democracy, we’re a Constitutional Republic and, as such, “legally” Trump is president and fuck you libs. The thing Republicans are wilfully oblivious to is how all of this would not happen in a political vacuum.

There will be severe consequences for everyone involved if they “win” (not lose) the election in the courts. That’s why calling the election was such a crucial step. Biden has won on a political level and, as such, any extra-political actions on the part of TrumpBarr-MAGA-Qanon to facilitate a Trump coup will spark a series of events that Republicans won’t be able to control.

The Big Ugly, as I call it, will happen.

Pretty much the entire country will go tits up and there will be no obvious endgame. There will be significant political violence up to and including something that will be a civil war or revolution.

But Republicans don’t care. They really don’t care. All they see is an opportunity to stay in power. So, they’re willing to go full autocrat to meet those ends.

I hope I’m wrong. I really do. But it’s definitely something to think about.

Donald Trump: Flight Risk

by Shelt Garner
@sheltgarner

I’m still not prepared to believe the Russians would allow Trump to lose. It makes no sense. Why allow such a valuable asset to be forced out of power? Why not hack into our election systems then “accidentally on purpose” get found out. A civil war breaks out when Republicans lulz this and win at SCOTUS. The Russians get the destruction of their main geopolitical foe.

But, let’s daydream. Let’s play pretend.

Politico recently did an article on Trump being a possible “flight risk.” I haven’t read the article — just saw the headline — so maybe they covered this already, but let’s mull where Trump might go.

There are two obvious places — Moscow and Pyongyang.

The reason Trump might leave the country is simple: he doesn’t want to go to prison. Now, of course, given how Trump and Senate Republicans have turned 1/3 of the Federal bench into a MAGA cheering squad, it’s easy to imagine a situation where SCOTUS not only validates Trump pardoning himself, but somehow pulls some bullshit explanation for why he can’t be indicted for state crimes, either.

That definitely seems a lot more likely than Trump leaving the country in a rather astonishing — and historic — fashion before January 20th.

But if Trump did do something so bonkers, flying to Moscow on AF1 then quitting right before January 20th definitely seems the most obvious. He would have the biggest country in the world to play with and he could spill all the state secrets he liked directly to the Russians.

I wouldn’t completely dismiss the DPRK, however. I say this because Trump definitely seems to have a personal affinity for “Little Rocket Man” and it would make a lot of sense for him to at least begin his post-presidential career hanging out with Kim Jung Un for a few months before flying to Moscow.

The only reason why I doubt Trump would do such a thing — even if he is a deranged moron — is even he knows because of SCOTUS he could beat any state rap and staying in the country would allow him to fuck with future elections and become the political Singularity of the Republican Party.

And, yet, Trump is a deranged moron.

So, I dunno.

The True Tragedy of The Trump Era

by Shelt Garner
@sheltgarner

Two major historical events come to mind when I mull how the Trump Era — should it come to a close soon — will be viewed. One is Watergate. Not only was it the crucible through which America entered the modern era, it was all around a big old tragedy.

If anything, Trump has taught us a very crucial lesson about Watergate. We thought Watergate established a gameplan for how a president might actually be removed from office if his or her crimes were bad enough. In fact, Watergate was a very specific event with very specific characters that was not really any sort of gameplan at all. It was simply a fluke.

Or, put another way, it was a construct of the era in which it came out of. People in 1972 – 1974 had some sort of shame. Some sort of sense of honor. Two qualities that absolutely no one in the Trump Administration has.

The point is, however, that nothing was the same after Watergate. The Republican Party became the part of the people who were Nixon deadenders. That core group of people — in the guise of Reagan — would come roaring back in 1980 as part of the Reagan Revolution.

The Reagan Revolution is the other big event that the Trump Era gives us some insight into. The reason why Reagan’s election was so important was many of the problems that would lead to Trump first began to form. The Republican’s obsession with SCOTUS. It’s obsession with cutting taxes and social programs. It’s hatred of anyone voting. The list goes on.

The key issue of this moment in time, however, is how it was a psychological break from the past. The entire country began to take for granted a number of what were previously far Right concepts.

So, here we are in the Trump Era.

It will be the biggest shock of my adult life if not only the Russians let Trump lose, but Trump doesn’t somehow start a civil war just out of spite and a fear of going to prison should he leave office.

But should Trump miraculously leave office and a Biden Administration start, I just don’t see how things snap back into place. Trump isn’t going anywhere. He’s still going to be an ex-president. He’s still going to demand a spotlight and he’s still going to have a Twitter account. What’s more, he’s probably going to salt the earth on the way out the door.

One subtle change, however, the thing that we’re all going to have to deal with, is Trump single handedly radicalized much of the center-Left the way the Obama’s second term radicalized the entire fucking Republican Party. We were sucker punched by Trump’s time in office and so a lot of the native goodwill that many center-Left people might give Republicans simply doesn’t exist anymore.

In a way, both sides are now equally radicalized and suspicious of each other. The only real difference between Republicans and Democrats is the latter actually believes in liberal democrats norms. And Democrats have some sense of shame. Republicans, meanwhile, don’t give a shit. They are so fucking craven, so blinded by ideology that they were more than willing to fucking destroy the whole country if they think it might give them just one more young hack MAGA judge.

But I still just don’t believe Trump is going to lose. He’s an autocrat and autocrats never lose. Never. It’s going to be the Russians. Or SCOTUS. Or some combination of both that allow Trump to “not lose.”

And I just don’t see Americans having it in them to do what would be necessary to force the issue and drive Trump out of office — a General Strike. I believe TrumpBarr will simply grow more radical as necessary, invoke the Insurrection Act and that will be that.

As I keep saying, on a strictly political level, Biden is doing quite well. But Trump is an autocrat — if a very incompetent one — and, as such, will never fucking leave office. And if he does leave office, you had better be sure he’s going to demand a pound of political flesh.

So, in the end, even if Trump is out of office, everything will be different. Our expectations have changed. There’s likely to be a Trump Deep State that will aggressively work to bring down the Biden Administration at every turn. The Fox News faux outrage machine will constantly be looking for different ways to recapture the glory of the Trump Era.

Trump will be the Republican Party’s new Reagan. Everything they do, everything they say, everything they believe in will be relative to Trump. They hate democracy and see it only as a means to an end. About half a dozen would-be younger, brighter, more focused autocrats are already chomping at the bit to finish the job Trump has begun.

Remember — even after the disgrace of Watergate, the Republicans just barely lost to Carter in 1976. Barely. It was one of the tightest elections in history. And they came roaring back just six years after Nixon left office in disgrace.

Should Trump physically leave office, we’re probably going to have three to six months to enjoy it before Republicans will shit on it all.

But I still, still will be completely flabbergasted if Trump loses. Too many powerful people — including Trump himself — will fight dirty to ensure Trump stays in power as long as he likes.

I Just Don’t See The Russians Letting Trump Lose

by Shelt Garner
@sheltgarner

Donald Trump is a very valuable investment for the Russians. All they would have to do to protect that investment is change votes in Pennsylvania and Florida just enough to make race as tight as possible — they wouldn’t even have to cause Trump to win.

Trump sues to stop the counting of votes as soon as possible on a national basis. He wins at SCOTUS because it’s now full of MAGA hacks and Trump “doesn’t lose.” What’s more, even if their direct ratfucking of votes was discovered “accidentally on purpose” the Russians would likely get what they wanted — a civil war. Even if we all knew the Russians changed votes, all that has to happen is Rudy to pop out of his crypt on CNN and yell at Chris Cuomo for an hour and that would be that. The Russians already said they want a civil war in the United States — the worse the better. AND they’ve said that Trump is “their guy.”

As such, the Russians allowing Trump to lose would be inexplicable.

The Big Ugly: The Conditions Exist For A Second American Civil War

by Shelt Garner
@sheltgarner

As we lurch towards Election Day, it’s becoming ever more apparent than at least on the basis of attitude of the two sides the conditions for significant political violence exists. On one hand, the Republicans are looking towards Amy Coney Barrett to be their failsafe in case the election is close enough that anything goes to SCOTUS. On the other hand, Democrats are pumped that on a political level, Biden may be on the cusp of a landslide.

Republicans are so craven — and so blinded by ideology — that they aren’t even factoring in the consequences of their anti-democratic behavior should they manage to pull it off. All they care about is a Trump victory and fuck you. So, it’s easy to imagine a situation where they get what they want: Trump wins, but that’s just the beginning of the crisis.

If Biden wins a massive landslide in the popular vote but because of the legal ratfucking of the Republican Party he doesn’t legally become president, we would be in uncharted territory.

Now, the fix to this problem is a Biden victory that is so enormous that it has some wiggle room to handle the very legal ratfucking I mentioned. We have to accept that Amy Coney Barrett is going to hand the election to Trump if that becomes an issue. The solution is for her not to be given the option.

Of course, if there is a Biden landslide, we would likely have to deal with significant political violence on the part of MAGA-Qanon who don’t see anyone but Trump as legitimate. Trump could pounce on such violence as something of a Reichstag Fire and assume the “total control” Roger Stone believes he should do, even if the violence was caused by his own supporters.

The point is — autocrats never lose. Never. I haven’t even mentioned the likelihood that the Russians are going to hack directly into our election systems to throw the election to Trump. Even if we discover this, it’s very likely the whole thing goes to SCOTUS…where Amy Coney Barrett will vote for Trump.

All in all, we’re fucked. We’re totally, completely fucked. I don’t see how we get through the next few months without some sort of massive political violence to the extent that we see an enormous amount of domestic political refugees.

The only way that doesn’t happen is a massive Biden win combined with Trump simply giving up. He will likely salt the earth on the way out, however. He’s going to fire anyone he doesn’t like and pardon anyone he feels he needs to in order to save his sorry ass — including himself!

The New Normal

by Shelt Garner
@sheltgarner

Our absolute best case scenario at this point is Trump will be a one term president who has a political legacy equal to the Reagan Revolution. There will be a new normal where the Trump Deep State actively attempts to destroy the administration of any Democrat that doesn’t toe the MAGA line.

That’s the best case scenario.

I say that because the dead hand of history would suggest that Trump isn’t going anywhere for any reason. Trump is actively working to turn the United States into an autocrat state and it would make absolutely no sense for him to allow himself to “lose” for any reason.

Add to this how the Russians are very likely to hack directly into our election systems as part of a quid pro quo for Trump removing 1/3 of our troops from German and it will be the biggest shock of my adult life if Trump ever leaves office for any reason.

Even if the Russians for some reason allow a Biden landslide, the damage Trump has done to the administration of government is so horrific that I find it difficult to imagine that things are going to just snap back to “normal.” Trump is our political herpes.

Or, put another way, the only upside to Trump’s tyranny is a lot of macro pressure on our political system has been eased because craven Republicans go two things they lusted after — young hack MAGA judges and a gratuitous tax cut for plutocrats that punishes Blue States. Republicans still hate democracy because they hate the Browning of America and the rise of women as a cultural and economic force, but if the Russians don’t do what I expect and Trump loses, at least they got there two big goals.

As their base grows smaller and more angry, they will use their control of the Judiciary and Trump’s new Deep State to create the conditions for them to get back power as quickly as possible. Every time they get power, it will grow a quantum leap more difficult to get them out of power. In the end, it will become completely impossible and at some point the country implodes and it’s every man for himself.

That implosion may happen in 2020, or it may happen between now, and, say, 2028. But it is going to happen for no other reason than Republicans have learned a lot from Trump and they will re-calibrate according to his weaknesses. If the implosion doesn’t happen, it will be because the next time they get to put an autocrat in power, he will be far more focused and organized.

But I still think everything is moot. Trump is never leaving office. Most Americans aren’t willing to risk their “lives and scared honor” in the real world to do anything about it.

So, soon enough, the United States will leave NATO, form some sort of new alliance with a number of autocratic states across the world and begin snatching people off the street and pushing them out of windows. This is going to happen, it’s just a matter of how long it takes.

If it doesn’t happen, it will be because people get woke and there’s a national implosion. I’m not advocating that. I don’t want that. But the macro trends indicate that if we don’t get woke on a mass level that Republicans are hell bent on turning us into an autocratic, American version of apartheid South Africa.

Election 2020 Known Unknowns

by Shelt Garner
@sheltgarner

How Tight Is It Going To Be?
On one hand, you have indications that we’re going to have a massive number of people voting, which would help Democrats in general. On the other hand, it’s possible that because of the Electoral College and the 48 – 48 split of the nation that even that won’t be enough to give us what we need: a massive blowout to such an extent that it makes it much more difficult for Trump to pull off A Very American Coup.

Russians Hacking Into Our Election Systems
I rant about this a lot, but I don’t, like, KNOW that this will happen. But Russia loves Trump so much that it makes sense that Trump removed 1/3 of our troops from Germany as a direct quid pro quo for the Russians hacking directly into our election systems. I could very well see Trump just barely winning Pennsylvania — and a few other states — and we’d just write it off to the 2016 effect of a split popular / Electoral College vote. We could simply never know what the Russians did. Maybe when AOC is let out of prison in 40 years we’d find out about it. But by that point, lulz.

Is Trump Too Incompetent & Lazy?
While Trump is an autocrat, he is a very lazy and incompetent autocrat. The thing that might cause him to overcome these basic aspects of his personality would be his abject fear of going to prison after leaving office. As such, it’s possible that using Barr he will stage A Very American Coup and never fucking leave office for any fucking reason. This is a very reason possibility — especially if there is any doubt on election night who won.

Are Americans Will To Risk Real World Things?
If TrumpBarr do stage A Very American Coup, is the average American willing to actually risk things that are important to them in the real world for the sake of the country? That’s probably the biggest known unknown. It could be that while there might be a bit of violence here and there, really all that would happen is a lot of angry Twitter threads.

October Surprises
Every day we get closer to the Election, the likelihood that something fucking bonkers is going to happen to upend the whole thing. I keep thinking it’s going to be a Hunter Biden Laptop Deepfake, but who knows. One thing is for sure — we’re already an autocratic managed democracy and for Trump to not think up some bullshit October Surprise would definitely not make any sense. So, it seems logical that things are going to turn on a dime and Trump is going to magically be in the lead again.

The Big Ugly
The weird thing about Trump is he literally keeps inciting violence and no one listens to him. The question is — is it possible that the moment it seems as though Trump is actually going to lose, will Right Wing nutjobs start to blow shit up in an effort to scare us into letting Trump stay in office? Or, put another way, it definitely seems as though an extra-political solution to Election 2020 is on the table if Trump loses by every other metric. It could be that the country convulses no matter who wins the election for any reason because we’re just too divided and it’s just our fate to have a revolution / civil war in 2020.

The Big Ugly: TrumpBarr Will Have To Be Physically Dragged From The White House If They Lose

by Shelt Garner
@sheltgarner

The old Benjamin Wittes quip is Trump is “malevolence mitigated by incompetence.” Another saw is “autocrats never lose.” By every possible metric, it seems as though Trump, through Barr, is going to stay in power by any means necessary even if there is a Biden landslide.

TrumpBarr would rather destroy the whole country than have Trump risk criminal exposure once he is out of office. Or, put another way, the only way Trump is leaving office should he lose is not only will he salt the earth on his way out, he’s going to demand some sort of promise about not being prosecuted once he’s no longer president.

I would even suggest he might frogwalk Obama between November and January to drive the point across — if you think me indicting Obama was bad, just wait until you try to do it to ME.

The issue is — Trump is an avatar for some seriously fucked up issue in American society. He’s like political herpes. Now that we have him, he ain’t going anywhere. Or, at least, his influence in government isn’t going anywhere. I think Trump is literally going to stay in office for the rest of his life, but that may be overstating the issue.

It could be that we’re simply in A New Era and Trump will be like Reagan was — there was life before the Reagan Revolution and life after it. I’m not one of those people who thinks Republicans will run away from Trump. To the contrary, Trump will be the new heart and soul of the Republican Party. Everything will be relative to him, just like it used to be everything was relative to Reagan.

Or, put yet another way, while I keep hearing people talk about how “fragile” our democracy is, I think we’re no longer a democracy. We’re now, officially, an autocratic managed democracy and the only possible way we have some sort of House Trump Interregnum is how God-awful incompetence Trump is at being an autocrat.

As such, we might have a few years of respite from autocracy, but soon enough, a new autocrat will take power and that will be that. It will be Trumpism without Trump. And I still think Trump will be like a reverse Gorbachev. Instead of bringing freedom to a country, Trump will strangle it.

Though I will note that while I’m often wrong, something really big has to happen for Trump to simply never leave office. TrumpBarr will use the same media narrative management techniques they used with The Mueller Report. The more difficult is for them to do this, the more radical they will become to the point that it’s rather brazen that A Very American Coup is taking place.

In the end, we may have to go through what I call The Big Ugly. And there are no assurances that the Good Guys will win if that happens.

Our Coming Hunter Biden Laptop Deep Fake Debacle

by Shelt Garner
@sheltgarner

So, that’s how Trump plans on winning. This mysterious laptop of Hunter Biden’s Republicans have discovered will have a video on it that will be released soon that makes every Qanon fucktard spooge their pants.

From Russia with love.

This is going to happen very, very soon. Probably in a few days.

We spend about a week debating as to how real it all is, but it serves the purpose of the Second Comey Letter and Trump “wins.” Soon enough, we learn it was a deep fake done by the Russians.

Add to this my continued belief that the Russians are going to hack directly into our election systems as part of a quid pro quo with Trump for him removing 1/3 of our troops from German and, well, there you go.

Trump wins and our dystopian nightmare kicks into high gear. We leave NATO, form a direct alliance with Russia and politically we’re identical to Russia. People start to get snatched off the street and pushed out of windows. We have a solid 40 years of this before the dead hand of demographics finally makes House Trump’s rule untenable.

The Bad Guys Are Going To Win

by Shelt Garner
@sheltgarner

I just don’t see any way that the bad guys of TrumpBarr don’t win. Even though I’m very pleased with how many people are voting right now, in the end, it won’t matter — TrumpBarr will likely nationalize the National Guard across the country Election Night and stop voting “until SCOTUS can figure things out.”

Or whatever.

We’re too far down the road to tyranny. In fact, we’re IN tyranny. Autocrats never lose. There’s going to be A Very American Coup and because we can’t get the conservatives-who-aren’t-MAGA to care, it’s going to be successful. There may be some violence and threats of secession, but in the end, nothing will happen.

It will all be decided at SCOTUS and it will just be a more extreme version of 2000. I just don’t see any other outcome. Even if there was a landslide, you have to actually count the votes, you know. TrumpBarr will either never let that happen, or they’re just going to sue everything and everyone to SCOTUS and win there.

Darkness is here. We’re in a dystopia. Get out of the country while you still can. Proles like me will just have to make do as best we can. I’ll be snatch off the street or pushed out a window by ICE soon enough. Maybe sent to a re-education came and die there. Who knows.

The only way that doesn’t happen is if people are willing to risk things important to them in the real world. I just don’t see that happening. And if they do, Qanon or whomever will respond in kind and the whole country will implode.

If that happens, then TrumpBarr uses the Insurrection Act from here on out. Maybe there will be a dystopian Second Reconstruction. Autocrats never fucking lose.

Good luck
